Joe - I set up a Montana LLC and have both my coach and motorhome under that umbrella - worked with an excellent attorney in Missoula who handled things quickly and very reasonably priced.... he continues to be very helpful to me... let me know if you want his info... dont think it matters what state you are in with regards to setting up a montana llc. jan

Some states like Colorado and California are on the lookout for residents with out of state plates on their RVs. When they locate "cheaters", they not only make them buy in state plates but asses sizable penalties.
I do not know about Ohio.

In Washington State, the cops are on the lookout for coaches with out of state plates towing a vehicle with WA plates.

Hi Joe,
We do not know about Ohio but when we bought our coach in 2007 we were told that if you have a stick built home in any state you should not do the Montana LLC route as it will lead to trouble. It was a good way to go for fulltimers with no residential property.

You don't want those kind of flags. In Arizona they go around to RV storage lots and take down license plate numbers. So, people take off their tags or keep them in inside storage and this seems to work. I know people who have written permission from the LLC to use the vehicle. Some people put all their vehicles in the LLC. I know a lot of people who have Montana LLC's and have been successful: but, I do think you need to have a consistent story line.

The Attorneys that do this in Montana can tell you if it will work in your home state. They know the laws.
Maryland is a state where it does not work. Maryland law states "any vehicle garaged in the state for 30 days or more" regardless of home state.

Some years ago Montana started offering their Corporate Database for sale. Many states jumped on that opportunity and use the database to cross reference. The database can be purchased here for 3600.00: MT Records (https://app.mt.gov/cgi-bin/corprecords/corprecords.cgi)
Some of the states have turned this into a mission to increase their tax base, levy huge fines and penalties. The Attorney's in MT aren't going to assist you in your home state if you have a problem. Buyer beware..

If you use the long form and itemize your deductions in order to have a smaller tax liability.......do you then consider yourself a tax cheat?

There is no rationalization for this, it's tax cheating pure and simple. To try to compare it to legal tax deductions is ludicrous.
I use the long form but I don't create a phony business to use as a deduction. If I did, it would be illegal, ooops, there it is....

In Georgia they have a List of Montana people who registered their RV in Montana to avoid paying Georgia Taxes and they go around looking to see if they have a Montana Tag and they do give out tickets and fines.
In Georgia, if you buy your RV from an Individual you do not have to pay Tax on it but the License Tag is still around $2,500 for a $335,000 CC Affinity which I am buying.

I started to use a Montana LLC but decided the same, that it was wrong. So I went to pay the taxes and buy the tag here in Oklahoma. So I gave them all the documentation from the purchase to pay the excise taxes. The OTC (OK tax comm.) charge 3.25 percent on a vehicle purchased so I though I knew approx. what the bill would be. After giving them the paperwork she said it would probably be about an hour before they knew what the value of the vehicle would be so the could determine what to charge me for the taxes. I said the Market determined what the value was as I bought it from a out of state dealer that was advertising it online. I was informed OTC determines the value of the vehicle not the market. OTC went to the NADA and got the value from that. So I got overcharge approx. $1000. for my tag and taxes as you can't get near the nada for MH's as of current and especially not then. So I got cheated. If I had it to do all over I would cheat the OTC as law is 3.25% on the purchase price but they decide the what the value of your coach is without ever seeing it.

? I don't have a Montana LLC but I did get a used dealers license in my state and run my RV with a used dealer tag on it which costs me very little. To get the license each year costs some but not near what the yearly tags would be. I also get a used boat dealers license since I have 9 boats and its only $50 a year.

I understand Nevada does something similar. I was told if you register in Nevada, you registration is based on the original retail value of the coach and that is does not go down. You pay the same registration fee every year you renew your registration in Nevada.
Can anyone confirm that or has registered their motorhome in Nevada?
Question: If you live fulltime in your coach and do not own any property; is there any issues with executing a Montana LLC?

You don't use your legal name or address so how can they track you to Georgia? The LLC is established with a business name which is a separate legal entity with it's own address in Montana and tax payer identification number. If you store your vehicle in sight with Montana tags visible then you deserve to get caught.

I think the best way to solve the problem is to suck it up and register all your vehicles in the state in which you live. That way you don't have to waste all that time and energy trying to avoid taxes and registration fees that in all reality, if you can afford to buy and operate a Country Coach, you should be able to afford anyway.

Unfortunately you are correct. They disregard the going/ market value and go off the original selling price.
Oh well, we have other tax advantages here---no state income tax is the best one.

They have the VIN Number of all those RVs Registered in Montana and they put them in their database. When they come upon an RV with a Montana Licence Plate or No License Plate they then get the VIN Number of the RV and see if it is in their Computer. Then they write a ticket and you have to appear in court or go to jail.
When you appear in court the judge rules that you are trying to avoid paying taxes and then penalties are then assessed against you along with court fees/charges/fines.
It seems some people have criminal minds and will do anything to avoid paying taxes even if it is illegal because they can Rationalize it in their mind that Big Government is Greedy and thus they are okay beating the Government out of tax money.
The correct way is the change the laws that you don't like not to try to break the law because you don't agree with the Law.

Most states advertise for "whistle blowers". Friends and neighbors are often quite happy to report on those with vehicles not displaying licenses for the same state as the person's residency.
Armed with this tip, the legal entity will develop a file based on interviews with whomever will talk and then work backwards to determine if a cross exists between a known corporation or name on a Montana motor vehicle registration or corporation.
California is reported to have by far the greatest sheer number of motor homes registered in Montana. Not surprisingly they are also reported to be the least aggressive investigators and most in need of the revenues.

I have had motor homes registered in Washoe County, Nevada since 1981. Our current coach is a 2003 Magna 42' Resort, and, as far as I can remember, our registration fees have dropped significantly each year.
