A California federal judge refused last week to grant preliminary approval for a $33 million settlement in a proposed class action against Norcold Inc., Thetford Corp. and Dyson-Kissner-Moran Corp. involving allegedly defective refrigerators, saying more information is needed on incentives provided to named plaintiffs, Law360 reported.
U.S. District Judge Josephine L. Stanton denied the plaintiffs' motion for approval of the settlement terms without prejudice, saying the court lacks adequate information to determine the incentive amounts for named plaintiffs, who would receive $100 per hour for their assistance, with a suggested $5,000 minimum award.

Lee,I thought you might be interested in seeing some stories that have been recently published on Forbes.com regarding the issues dealing with the Norcold refrigerator fires and defective cooling units. Exploding RV Refrigerators Spark A War Among Plaintiff Lawyers Lawyer Seeks Norcold's Financials As Company Disputes Forbes ArticleThe current status of this class action lawsuit is that the Judge has refused so far to accept the proposed settlement that is objected to by myself and several of the other named plaintiffs in this case who have become objectors. We feel that the settlement is inadequate, unfair and against the interests of the class members as a whole. In the most recent hearing the Judge has allowed the attorney who is representing the objectors - Mr. Terry Beard - to move forward with discovery regarding the defendants (e.g. - Norcold, Thetford, DKM) corporate financial and insurance information. Norcold has plead poverty and potential bankruptcy if they are exposed to a fair settlement in the case, which we have disputed based upon their failure to produce adequate financial documents to back up those assertions. Additionally, Norcold / DKM / Thetford have mysteriously claimed that they now have no liability insurance to protect their companies regarding these lawsuits - which is pretty unusual and contrary to statements in other lawsuits that they have faced regarding the fires, personal injury and property damage that their defective cooling units have caused over the course of the last 14 years. As a result of these issues, as well as the fact that some of the named plaintiffs were granted significant personal payments of claims in order to garner their support for the terrible proposed settlement, the Judge has refused to accept the proposed settlement and is allowing discovery to move forward. These issues will be addressed by the court in the next 60 days prior to the next scheduled hearing.I hope you find this information to be of assistance.
