Title: Buying a new coach in California...

Thinking of buying a new RV soon.....

Just learned that California SB1100 was signed into law on July 30, 2004. The new law basically changed the out of state delivery from 3 months out of state to 12 months out of state. It goes into effect on October 1st, 2004. Any purchase contract for a California resident prior to that will be grandfathered into the three month time period rules. If you meet these conditions, you save on the sales tax using a feature of the tax laws.

I am presently in the review process of my California Use Tax exemption. After the runaround I have received from the Board of Equalization, I will never register another MH in California again.
Next one will have Montana plates on it....Guaranteed. Do yourself a favor and look into setting up a Montana Corporation deal.

There is a better approach - Alaska.
MH doen't not have to be there, cheaper than Montana. Get your driver's license while your there also.

I did an out of state delivery in February of 2003. I am curious, when did you take delivery of yours? I was under the impression that the Board of Equalization audits all of the requests, but I have no idea what the statute of limitations is.

I purchased July '03 from a private party in Michigan. I am not sure what you mean about the auditing.

Back in '99 we took out of state delivery and never heard from BOE.
We took out of state again in Aug '01 and we received a letter from them in Feb'02. All info was provided to them and one year later we got the all clear letter. We did receive a letter during the audit process saying we could pay the tax if we thought we had made a mistake. At all times communication was done by letter. If you have all your records complete, there will be no problem. If you stored the coach and showed a receipt for such, you might have a problem.
The key word in the whole out of state thing is "use".

If you are trying to deal with the BOE issue thru DMV, good luck.
They don't have a clue as to how the law works, they are just a collection agency for BOE. The only thing they know is you owe, you owe, you owe.
