That message and all replies, when I discover they are posted, are deleted from this forum. They become new members the day of the posting and were banned as soon as I read the daily digest yesterday, less than 24 hours later.

TO ALL MEMBERS: Please, there is no need for any forum member to reply on the forum to these type of messages. Or even reply to replies!!! As I have mentioned earlier, even if I delete a message from the forum web site, it still get distributed in the next daily digest -- an unfortunate design by Yahoo. Even on my current 9 week trip, messages like these are removed by 6:00 a.m. PT.

Hi Candy,

Well... I canceled the order on the Magna the middle of August, because we still have not sold our coach. I think it is harder because it only has one slide, but who knows. Anyway, we had agreed that if it did not sell by 8/1/04, we would cancel the order and consider that it wasn't meant to be. (Mostly because Lonnie wanted a used Newall)
Anyway, then the report came out that if you purchase after 10/1/04, you will have to leave your coach out of state for 1 year (or six months out of the 1st year) SO... we decided maybe we had better buy something. PLUS and most importantly, our CPA told us we need the write off!! Of course now, to get a special order it would take too long and it is slim pickins at most dealerships, however, we found a 2005 C.C. Intrigue Ovation LE triple slide at Lazy Days and made a deal with them to take our coach in trade and they gave us a good deal on the Ovation. We are to pick it up around the 11th of October in Florida... if there is any Florida left by then!
Other than that, we are both doing fine. We can't pick up the new coach until the 11th, because we don't want to miss the Mr/Mrs in Kingsburg! :}
Where are you guys and how are you both doing? Is everything fine with your coach now? Did you notice on the new ones they put a lock on the refridgerator door? I thought of you when I saw that! :} Dummies.
We had such a bad experience with the service department when we took our coach up to have the awnings fixed and I left there very angry. When I got home I sent a letter to Bob Lee and they were much more accomodating when we went back up. I was ready to tell them they could take the Country Coaches and put them where the sun don't shine! If you don't get good service, you might as well have a Safari or anything else and I told them so. Sounds like maybe they are working on getting the service back up to where it used to be. I hope so.
I'd better run. We are having dinner with friends tonight. Take care and keep in touch. Tell Dale hello for us.

Does anyone have an idea of who to contact in Washington state about this. If I don't bring my vehicle in the state for a set amount of time I should not have to pay the sales tax. I contacted one of the auto licensing departments and they gave me the typical answer: "Don't worry about it just give us the money".

Another update. California called back a friend of mine and said they gave him the wrong information. They now say that you only need a contract buy October 1, 2004 to keep the 90 day loophole.

Just an FYI so everyone is aware... we personally went and met with the California State Board of Equalization and you must take delivery (have the signed & notarized form showing proof of delivery out of the state) BY October 1, 2004... not just a signed contract with the dealer. That will not work and you must leave it out of state for a consecutive 91 days. On/after October 1, 2004, you will be required to leave the coach out of the State of California for six (6) months during the first year. Of course, you must be able to provide receipts for fuel, food or anything in other states during this time. They want to see documentation.

When I checked with the Board of Equalization, I was told that I must be using the motorhome and provide, as was noted in the previous post, receipts showing purchase of groceries, fuel, campsite rents, etc. These items are to prove that the owner was, in fact, using the vehicle out of state and not just parking it somewhere. The law does say using the vehicle, doesn't it? I expect they will be investigating those of us who have taken advantage of this loophole and if they have any questions, it will be our responsiblility to prove that we followed the law. Good luck to anyone who tries to skirt the law...they'll be coming to get your money - including fines and interest.8-) And considering the condition of the CA budget, they'll be looking hard.

If I were to purchase a motorhome in CA am I responsible for the sales tax? My present vehicles are registered in SD. Yes... use your SD address... There is no legal reason you can't buy in any state you get the best deal. Many people do this all the time.
The trick will be where you opt to register it later when you choose a permanent state for residency. If you choose CA then I would check the cost of registering it there... including any applicable sales tax. I beleive CA is one of the states where they charge sales tax on the full purchase amount and don't reduce the purchase cost by subtracting the value of your trade in. So watch your flank very close on this.
I am not sure if the license plate can simply be switched. SD DMV would know the answer to that. If you can't get temporary tags for a couple months.
Point being, I don't think your purchase method is unusual and the qualified answers from the (not me) should be discussed.

If you were to purchase a new coach in CA and register it in SD( you are not required to register in the state where you purchase), you would pay sales to SD only. If you have a trade, the tax will be figured on the difference between the sales price and trade price. (If you have a 100,000 trade value and your new purchase price is 300,000, then you would pay tax on 200,000). In SD, the license plate stays with the vehicle, you do not transfer to old plate to the new vechile.

If you take delivery in CA, you will probably be required to pay the tax...even if you license it in SD. I'd recommend not buying in CA...there are many good dealerships in other states and some who have stores in CA who have stores in other states. Thanks Carol for the info below. You do seem to explain the situation well. My problem though is that I am interested in purchasing a Lazy Daze class C which is manufactured in CA and sold only from the factory.
No dealers are used at all! I believe that they do have a program of delivering the coach to you out of CA but then the new CA law kicks in.
Presently, to Oct 1, you have to be out of CA for 90 days. The new law I thought says one year but others have written 6 months...Hence there still seems to be some confusion on the issue...Thanks again, rvmike.

You can then try to get it back...The only way to get around not paying the tax is to take delivery outside of CA. The present CA law allows this if one stays out of CA for 90 days and uses the RV out of the state (you cannot just park it but have to prove usage). The new law, starting next week, changes that time frame to either 6 months or a year. I am not too sure of the laws as I do not live in CA. Want to fight city hall? Buy a RV within CA and have fun!

IMHO Full-timers are entitled to take advantage of tax savings by registering in whatever state they choose.
Folks who own a motor home and real estate and reside in a specific state are required by law to pay sales tax in that state. Period. New paragraph.
My sales tax was $12,800 and my annual property tax is about $2,000. Can I do anything about it? No! Do I spend any time lamenting and trying to beat the system? No! I register the coach in my home state, use the roads and take advantages of the services provided. That's how the system is supposed to work. No?

Check with an attorney to be certain; you may be able to license it in TX, but you may still have to pay CA taxes unless you take delivery outside of the state. The best information we can give you is that of just plain coach owners. To my knowledge, none of us is a lawyer, nor are we experts in the subject. We share what we know, but in this situation, where a mistake could cost you thousands of dollars, you need an expert. JMO

I would certainly explore the process with the dealer if I were about to purchase.
The whole assumption of paying CA sales tax for a new purchase when you live and register in another state seems ludicrous.
Does anyone realize how many people in other states buy a MH out of state and register it? I have done this on car purchases many times. The tax paid is always in the state you are registering in.
It would seem CA dealers would be at a distinct disadvantage in competing for any out of state business.
I just wonder if many of the posts claiming a CA purchase by an out of state person aren't the classical assumption!

Exactly Carol. I was hoping that there would be CA residents who could shed some light on this subject. In my case (or someone very close to me) they want to buy a unit from a CA manuafacturer (not a dealer). The manufacturer does provide a service (for a fee) of having a professional driver deliver the RV to you in either AZ or NV. A notary is also provided at the delivery point to make everything legal. That part is fine but what interests me further is whether you can then turn around and enter CA? I agree the issue is ludicrous and I write from NYS and am residing in SD! Yet the new CA law I believe states that the RV must be out of CA for a year and used (not parked) for that year. I agree this is all nuts but do not want to get hit with a tax bill or fine.

On a new purchase expect to pay the amount pertaining the rules of the state of registration. On a used MH being re-registered in a different state the rules can vary from state to state where, after a period of time no tax is required, the tax is computed on value, and in some cases you are given credit for taxes paid in the state of your previous residence. I am sure there are other scenarios also. Just check the rules of the state you are registering in.
