I concur with Jim, you should really consider some type of aux breaking system for the toad. I tow an Acura MDX and have had no problems.

I don't know about the other states, but in Nevada any towed vehicle over 1500 lbs must have a breaking system on it. I tow a Ford 250 PU 4wd with a Brakemaster form Roadmaster and my rig stops as if there were no truck behind at all. Easy to install.
